A petition has been filed in the Supreme Court seeking an order on all agencies not to influence the top court in the constitutional case to quash the amendment that would disqualify MPs for switching parties.
The petition was raised by former Kendhoo MP Ali Hussain who also submitted the constitutional case to revoke the amendments to Article 73 of the Constitution.
Ali Hussain requested the Supreme Court issue an order under the Judicature Act as ongoing disciplinary proceedings to remove Supreme Court Justices could disrupt public order when a case connected to public interest was about to start.
He said the reason for submitting the petition is because the Judicial Service Commission (JSC) was inquiring into Supreme Court Justices as they were preparing to begin the constitutional case on February 17.
He also highlighted reports about a criminal investigation connected to a Justice and preparations to remove Justices through the parliament.
Ali Hussain earlier called on the government not to use influence and undermine the independence and autonomy of the Supreme Court.
The case scheduled for 11:00 am Monday will be heard by a seven-judge bench. Chief Justice Ahmed Muthasim Adnan will preside over the hearing.
With the new constitutional amendments, MPs will lose their seat if they defect from the political party under whose ticket they were elected, join a political party after being elected as an independent candidate, or voluntarily leave or are expelled from their political party while in office.
