The Civil Court on Thursday ordered the Housing Development Corporation (HDC) to hand over copies of agreements made with K Park Residence developer Hanbo Maldives to a buyer of an apartment from the unfinished building.

Fathmath Asiyath, from Laamu Fonadhoo, sought the order from the Civil Court as documents needed for her lawsuit against the Hanbo company.

The documents include:

  • Copy of the first agreement made between HDC and Hanbo in 2016
  • Copy of any amendments made to the agreement
  • Copy of related document if there was a project security
  • Copy of document if any other party had been granted powers to enforce a provision in the agreement
  • Copy of document provided by HDC to Hanbo as permit to sell buildings from Hulhumale'
  • Details of action taken over Hanbo's failure to build flats within agreed upon period

The Civil Court ordered HDC to hand over copies of the requested documents to Asiyath within 14 days from last Thursday. Asiyath was ordered to only use the documents to prepare her lawsuit.

The court also ordered the submission of the lawsuit before July 30. If the case is not filed before the deadline, Asiyath was ordered to return the documents to HDC without making any additional copies.

The K Park project was undertaken by the Hanbo Maldives company formed in partnership with Korea's Hanbo company. A Chinese national named Jin Shihu holds 95 percent of shares in the company. Hassan Mamdhooh 'Mandey' was the company's minority shareholder with a five percent stake.

A police investigation was launched at the request of HDC after Hanbo Korea put out a statement and Immigration held Mamdhooh's passport with a court order.

The state raised 101 charges against Mamdhooh, the prime suspect in the alleged fraudulent sale of K Park apartments, and 98 charges against his alleged accomplice Jaishan Saeed from Raa Alifushi. The charges were raised over the defrauding of a total of 51 people, the Prosecutor General's (PG) office said.

Separate cases are also ongoing against Hanbo at the Civil Court. The court has concluded some cases and ordered compensation for the apartment buyers.
