Hassan Fawaz, who is accused of being the mastermind behind the plot to kill Naeema Moosa in Noonu Manadhoo island, has been transferred to house arrest.
Fawaz was remanded in custody pending trial. He was placed under house arrest at the request of the Prosecutor General's (PG) Office.
Fawaz was charged with manslaughter, obstruction of justice and abuse of corpse. The PG Office believes he offered drugs to have Naeema murdered.
The PG Office said they asked the Criminal Court to transfer Fawaz to house arrest as a special measure to protect his right to life under Article 21 of the Constitution.
This was done on the advice of a medical doctor due to his illness, the PG Office said, adding that Fawwaz had agreed to conditions set by the court.
They include:
- Cannot commit any illegal acts or other offences while under house arrest
- Must appear in court on time
- Cannot leave home between 6:00 pm and 8:00 am except for medical treatment
- Must appear and sign at the nearest police station between 8:00 am and 12:00 pm every day, except when leaving for medical treatment
- Cannot leave Male'
- Must not communicate, meet or influence witnesses
- Share updated medical documents with the PG Office and the Criminal Court every 15 days
During his house arrest, police and corrections will monitor whether Fawaz is complying with the conditions.
If he violates any of the conditions, the PG Office will ask the court to transfer him to jail immediately.
When Naeema was found dead in her home on April 7, 2023, there was a lot of blood on the ground. She was stabbed multiple times.
Naeema was 62 years of age when she died. She was survived by three children. While she was married twice, neither of her husbands is now alive.
